1. Scope and Provider Information

General Notes

The following General Terms and Conditions (GTC) govern the use of the online platform iventiks.de. They distinguish between two user groups:

  • Visitors who view events and retrieve information,
  • Organizers who publish their own events or book paid advertising services.

Scope of these GTC

These GTC apply to all content, functions and services provided via iventiks.de.
Additional provisions apply to organizers (see § X “Conditions for Organizers”).

Divergent Terms

Divergent terms and conditions of users shall not apply unless the operator has expressly agreed to their validity in writing.

2. Description of Platform Services

Type of Services Offered

The platform iventiks.de is a digital event calendar that collects and publishes information on cultural, musical and other public events. The operator provides visitors with a central overview of current events and enables organizers to present their events.

No Organizer Role of the Operator

The operator of iventiks.de is not the organizer of the events listed on the platform. Responsibility for execution, content, procedure, changes or cancellations lies solely with the respective organizer.

Source of Content

The data published on the platform may be researched by the operator or provided by organizers. The operator assumes no liability for the completeness, accuracy or timeliness of such information.

External Links and Ticket Pages

iventiks.de may link to external websites, including ticket shops or organizer pages. The operator assumes no responsibility for their content, prices, availability or technical functions.

Advertising Content

The platform may contain paid advertising formats or highlighted event placements. These contents are appropriately marked.

3. Registration and User Accounts

General Notes on Registration

Users can optionally register on iventiks.de to access additional features. Registration is possible as:

  • Visitor, or
  • Organizer.

    The type of user account determines which functions are available.

Registration as Visitor

Visitors may create a free user account. A visitor profile provides the following options:

  • Creating and managing personal lists of events
  • Adding events to external calendars (e.g. Google Calendar)
  • Receiving reminders, announcements and other notifications by email
  • Using additional convenience-oriented features of the platform
    The operator does not guarantee the constant availability of these additional functions.

Registration as Organizer

Organizers can create a special account to publish their own events. By registering as an organizer, they expressly agree to:

  • take full responsibility for the accuracy, timeliness and legality of all published content,
  • upload only such texts, images or data for which they hold the necessary usage rights,
  • respond to user inquiries or complaints in a timely manner.
    Organizers may also book paid advertising services (e.g. banner advertising, prominent placements, newsletter advertising). Details on available services can be found here: https://www.iventiks.de/fuer-partner

User Obligations

All registered users are obligated to:

  • provide accurate and up-to-date information when creating an account,
  • keep login credentials confidential,
  • not transfer the account to third parties.
    The operator reserves the right to suspend or delete accounts if users violate these GTC or misuse platform functions.

4. Registration and User Accounts

Mandatory Registration for Organizers

To publish their own events on iventiks.de or to use paid advertising services, organizers must create a personal user account.

Complete and truthful information must be provided during registration. Organizers are required to update their data immediately if changes occur.

Responsibility of the Account Holder

The account holder is responsible for ensuring that login credentials are kept confidential and not shared with third parties.

All actions performed through the user account are deemed to have been initiated by the account holder unless misuse is proven.

Use of the Account

The organizer account may be used solely to manage the organizer’s own events, book advertising services and use available partner functions.

Transferring the account to third parties or sharing it with additional persons is prohibited.

Blocking and Deleting User Accounts

The operator is entitled to block or delete user accounts if
– false information was provided,
– the platform is misused,
– legal regulations are violated, or
– content is published that violates these GTC.

The organizer may request deletion of the account at any time, provided there are no outstanding bookings or ongoing services.

5. Ordering and Payment of Paid Services

Ordering Advertising Packages

Organizers can select available advertising packages and paid placement options in their personal user account. Descriptions of services, durations and prices are visible directly in the account.

After selecting a package, the organizer is redirected to the order or payment page. Only after completing the payment process does the organizer submit a binding offer to purchase the selected service.

Payment Methods

The following payment methods are available:

  • PayPal
  • Stripe (e.g. credit card, SEPA, Apple Pay*)
  • Klarna (e.g. instant transfer*)

* Specific sub-types depend on the configuration of the respective payment provider.

All payments are processed via the respective payment service providers. Their terms and privacy policies apply additionally.

Activation of Advertising Services

Paid services are activated only after successful receipt of payment. The organizer can view the status of all booked services in the account, including duration and activation date.

Invoicing

After completing the payment, the organizer receives an invoice/payment confirmation by email and, if enabled, in the user account for download.

6. Obligations of Organizers and Responsibility for Content

Responsibility for Provided Content

Organizers must ensure that all content they submit—including texts, images, logos, event details and other materials—is complete, accurate and up to date. They warrant that all information is truthful and not misleading.

Rights to Images, Texts and Other Materials

The organizer guarantees that they hold all necessary usage rights for the uploaded content, including copyright, trademark and personality rights.

They agree not to upload content that violates third-party rights or legal regulations.

Prohibited Content

Prohibited content includes:

– content violating applicable law;
– violent, discriminatory, pornographic or extremist content;
– misleading or false information;
– content infringing third-party rights (copyright, trademarks, personal rights);
– advertising for non-existent or unauthorized events.

Indemnification from Third-Party Claims

The organizer indemnifies the operator from all claims made by third parties arising from content provided by the organizer. This includes claims for copyright infringement, trademark infringement or incorrect event information.
The indemnification also covers necessary legal defense costs of the operator.

Duty to Update Information

The organizer must immediately update or report changes to their events (e.g. date changes, venue changes, cancellations) to ensure timely adjustments.

Deletion or Blocking of Content

The operator may delete or block content that violates laws, these GTC or third-party rights, or if justified complaints are received. There is no obligation to notify the organizer in advance.

7. Liability of the Operator

Principles of Liability

The operator is liable only within the scope of statutory provisions and solely in accordance with the following regulations.

No Liability for Event Information

The operator is not the organizer of the events published on iventiks.de.

Responsibility for content, data, descriptions, dates, venues, images and other event-related information lies exclusively with the organizers.

The operator provides no guarantee for accuracy, timeliness, completeness or execution of organizer-published events.

No Liability for Changes or Cancellations of Events

The operator assumes no liability for:

– program or schedule changes;
– postponements, venue changes or cancellations;
– damages incurred by visitors from event participation;
– actions or omissions of organizers.

Liability for Technical Availability

The operator attempts to ensure high availability of the platform but cannot guarantee uninterrupted, error-free operation.

Maintenance work, technical problems or internet disruptions may cause interruptions.

Limitation of Liability

The operator is liable for damages only:

– in cases of intent or gross negligence,
– for injury to life, body or health,
– or for breach of essential contractual obligations (cardinal obligations).

In cases of slightly negligent breach of cardinal obligations, liability is limited to foreseeable, typical damages.

No Liability for External Links

The operator assumes no responsibility for external websites, especially ticket shops and organizer sites linked on iventiks.de. Responsibility lies solely with the respective site operators.

8. Copyright and Usage Rights

Rights to Content of the Operator

All content published on iventiks.de, including texts, graphics, logos, images, data collections, software and layouts, is protected by copyright or other rights owned by the operator or the respective rights holders.

Any use, reproduction, distribution or public display of this content is prohibited without the operator’s explicit written consent.

Content Provided by Organizers

Organizers who upload or submit content (e.g. texts, images, logos, event photos) guarantee that they hold the necessary usage rights and do not infringe third-party rights.

By uploading or submitting content, the organizer grants the operator a simple, non-exclusive, unlimited right to:

– display the content on iventiks.de,
– edit the content (e.g. cropping, resizing, correcting minor errors),
– use it in promotional materials for the platform or the respective event.

Responsibility for Uploaded Content

The organizer bears full responsibility for the content they publish. The operator is not required to check content for legal violations.

Upon receiving evidence of legal infringements, the operator is authorized to block or permanently delete content.

9. Applicable Law and Jurisdiction

Applicable Law

All legal relations between the operator and users are governed by the laws of the Federal Republic of Germany.

Mandatory consumer protection regulations of the user's country of residence remain unaffected.

Jurisdiction for Entrepreneurs / Organizers

If the user is an entrepreneur within the meaning of § 14 BGB, particularly an organizer booking paid services, the exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is the operator’s registered business location: Görlitz.

Jurisdiction for Consumers

For consumers, the statutory jurisdictions according to §§ 12–14 ZPO apply. No jurisdiction agreement is made with consumers.

10. Dispute Resolution

No Participation in Consumer Arbitration

The operator is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board under the German Consumer Dispute Resolution Act (VSBG).

EU Online Dispute Resolution (ODR Platform)

The European Commission provides an online dispute resolution platform (ODR platform). You can find it at:

However, the operator does not participate in dispute resolution procedures and is not obliged to do so.

11. Cancellation and Refund of Advertising Services

General Notes

Advertising services for organizers are digital services that are individually provided after booking and may be executed immediately. Therefore, special regulations apply regarding cancellation and refunds.

No Refund After Start of Service Provision

Once a booked advertising service has been fully or partially provided or activated (e.g. banner publication, highlighted event placement, newsletter dispatch or preparation), there is no entitlement to a refund of the paid fee.

Cancellation Before Start of Execution

Cancellation by the organizer is only possible as long as the service has not yet been activated or technically prepared.

In this case, the operator may, at its discretion:

  • cancel the order free of charge or
  • charge a processing fee.

Incorrect Bookings / Duplicate Payments

If an incorrect booking or duplicate payment is proven, the operator will refund the overpaid amount in full.

Failure of Service by the Operator

If a booked advertising service cannot be provided due to technical reasons attributable to the operator, the organizer will receive either:

  • renewed provision of the service or
  • a full refund of the corresponding fee.

No Refund Due to Event Changes

Changes, postponements or cancellations of an event by the organizer do not entitle the organizer to a refund for advertising services already executed or activated.

12. Invoicing

  • For paid services, the operator issues an electronic invoice pursuant to § 14 UStG.
    The invoice is made available to the organizer after payment is received, either automatically in the user account or by email.
  • For payments via online services such as Stripe, PayPal or Klarna, invoicing takes place only after successful completion of the payment process, as payment is initiated immediately during the order process.
  • The organizer agrees that invoices will be provided solely in electronic form. There is no entitlement to postal delivery.

General Notes

This section describes how invoices for paid services are issued and how payment confirmations are processed.

Invoicing for Online Payments (Stripe, PayPal, Klarna)

  • For online payments via Stripe, PayPal or Klarna, invoicing is automated.
  • The invoice is issued post factum, i.e. immediately after successful completion of the payment process.
  • The invoice is
    – either automatically sent by email,
    – or provided in the user account under “Invoices / Payments” for download.
  • The invoice date corresponds to the date on which payment is received by the operator.

Invoicing for Other Payment Methods (if available in the future)

  • If additional payment methods are offered in the future (e.g. SEPA direct debit or bank transfer), the invoice will be issued after payment is received.
  • Service provision begins only after payment has been received, unless expressly agreed otherwise.

Organizer Data Requirements

  • The organizer must provide complete and correct invoice details (name, address, company information if applicable) in the user account.
  • Changes to invoice data after invoicing can only be made within the legally permissible scope.

Storage and Access

  • The operator stores issued invoices in accordance with applicable tax retention requirements.
  • The organizer can access invoices at any time via their user account, provided it remains active.

14. Final Provisions

Applicable Law

All legal relations between the operator and users of the platform are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protection under the laws of their country of habitual residence.

Place of Jurisdiction

If the user is a business entity, a legal entity under public law or a public-law special fund, the exclusive place of jurisdiction for all disputes arising from or relating to the use of the platform is the operator’s registered business location.

Contract Language

The contract language is German. Translations (e.g. into Russian or English) are for information purposes only and have no legal effect.

Amendments to the GTC

The operator reserves the right to amend these GTC at any time for valid reasons (e.g. legal changes, feature extensions, business model adjustments).
Significant changes will be communicated to registered users in text form in a timely manner. Continued use of the platform after the notification constitutes acceptance of the amended terms, unless the user objects.

Severability Clause

Should individual provisions of these GTC be wholly or partly invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by the statutory provision that best reflects its economic purpose.

14. Final Provisions

Amendments to the GTC

The operator reserves the right to amend or supplement these General Terms and Conditions at any time. Significant changes will be communicated to users in due time and in an appropriate form. Continued use of the platform after the amendments take effect is considered acceptance of the updated terms.

Severability Clause

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall not be affected. Where legally permissible, the invalid provision shall be replaced by a provision that most closely reflects the economic intent of the invalid provision.

Jurisdiction and Applicable Law

The laws of the Federal Republic of Germany apply.

If the user is a business entity, a legal entity under public law or a public-law special fund, the exclusive place of jurisdiction is the operator’s registered business location.
